This Privacy Policy, last updated on January 31st, 2020, governs the manner in which Cloud Payments, LLC (“Cloud Payments”) collects, uses, maintains and discloses information collected from users (each, a “User”) of the Cloud Payments.com website (the “Site”) and platform (the “Platform”). By accessing or using the Site or any components of the Platform, you acknowledge that you have read, understood and accept the terms of this Privacy Policy. This privacy policy applies to the Site, the Platform, and all products and services offered by Cloud Payments.

Definitions

  • User: Refers to an entity, their employees and authorized vendors and contractors, that access the Site and the Platform with provided access credentials.
  • User Data: Refers to
    • Data provided by a User to the Site or the Platform about themselves, their employees, or vendors, including but not limited to personal information (PII), timezone, location, etc.
    • Data collected by the Site or the Platform about the User such as, but not limited to, IP address, device identification and data, geographical location, login times, etc.
  • Customer Data or Consumer Data: Refers to data provided by User, or services, devices, or vendors owned, contracted, or leased to or by the User, that send data to the Site or Platform about entities they interact with, provide services to, including but not limited to payment processing and routing, loyalty, rewards, offers, etc. The data may include, and is not limited to, personal information (“PII”), age, marital status, profession, location, behavior, preferences, affinities, transactions, visits, activity in social media, etc.

Information You Voluntarily Provide To The Cloud Payments Site

You may use the Site anonymously without providing Cloud Payments with any information about yourself. Cloud Payments only collects personally identifiable information that you voluntarily provide, such as (i) when you provide your name and email address to receive announcements and press releases in order to stay up-to-date on Cloud Payments, (ii) when you request Cloud Payments to contact you by providing some or all of the following information through the “Contact” link on the Site: name, email address, phone number, company name, and any additional information you provide voluntarily, or (iii) in connection with other activities, services, features or resources Cloud Payments makes available on the Site. Users may decline to supply personally identifiable information, however this may prevent them from engaging in certain Site related activities.

Other Information the Cloud Payments Site Collects

When you visit the Site, Cloud Payments may automatically collect some information about your visit using cookies (see below), log analysis software and other aggregate tracking technologies. This includes, but not limited to, information relating to how you use the Site, including whether you visit certain areas of the Site or whether you click through to a Cloud Payments article or view a Cloud Payments video or newscast, and may also include technical information including the browser name, the type of computer and other information about the User’s means of connecting to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Information You Voluntarily Provide To The Cloud Payments Platform

You as a User may only access the Platform using login credentials provided by Cloud Payments or another of your organization’s Users. Login credentials can only be provided after Cloud Payments collects personally identifiable information about you that you or your organization’s other Users voluntarily provide, such as your name, phone, email address, loction, company or organization name, and any additional information that you or other authorized Users of your organization choose to provide. Due to anti-fraud and anti-money laundering regulations in the U.S. and many other countries, you cannot access and use the Platform without providing personally identifiable information about you.

Other Information the Cloud Payments Platform Collects

When you, or any device configured to use your access credentials, access the Platform, Cloud Payments may automatically collect some information about you or your devices using logs, cookies (see below), log analysis software and other aggregate tracking and logging technologies. This includes, but not limited to, technical information about the device used to access the Platform, how and when access occurs, which actions awere taken, which information was requested, any error messages displayed, how long you or your devices remained connected, which networks and service providers were utilized, location of the devices, and other similar information.

Use of Cookies on the Site and Platform

The Site or Platformmay use “cookies” to enhance the User experience. A User’s web browser or other device or interface may place bits of information called “cookies” on the User’s hard drive, memory, or other intormation-storing technology for record-keeping purposes and sometimes to track information about the User. Cloud Payments will not sell, exchange or otherwise distribute your personally identifiable information without your consent, except to the extent required by law, in accordance with your instructions, or as identified in this Privacy Policy.

Cloud Payments may use your information, including personally identifiable information, for business purposes including, without limitation, the following:

  • To improve the quality of your Site visit and/or Platform access and usage, to personalize your Site visit and/or Platform access and usage, and to provide or restrict your usage to the levels established by your SLA.
  • To send marketing communications, emails, newsletters, and other information that you have requested, opted-in to or otherwise agreed to receive.

Also, Cloud Payments may use your information, including personally identifiable information, as follows:

  • Cloud Payments may contract with other companies and individuals to perform functions or services on its behalf, such as hosting and maintaining the Site and the Platform, payment processing, database storage and management, sending email messages and informational newsletters and administering surveys. These service providers may have access to your personally identifiable information, such as your email address, needed to perform their functions, but are restricted from using it for purposes other than providing services for Cloud Payments.
  • Cloud Payments has the right to disclose any information about you, including personally identifiable information, or your use of the Site, without your prior permission if Cloud Payments has a good faith belief that such action is necessary to: (a) protect and defend the rights, property or safety of Cloud Payments or its members, managers, employees, agents, other users of the site, or the public; (b) enforce the Terms of Use for the Site; or (c) respond to claims that any content violates the rights of third parties or is otherwise unlawful. Cloud Payments may also disclose information, including your personally identifiable information, as it deems necessary to satisfy any applicable law, regulation, legal process or governmental request.
  • Cloud Payments may share any information you submit to Cloud Payments when Cloud Payments has your consent to do so, or when Cloud Payments needs to share the information in order to provide the information or service you requested.
  • Cloud Payments may use your information to contact you regarding your account status, upcoming maintenance windows, to provide and communicate information pertaining to the Site or the Platform, to communicate a promotion or survey, amongst other similar activities.
  • Cloud Payments may use your information to uncover and diagnose problems with the Site and Platform and servers and for day-to-day system administration needs.

Cloud Payments will not sell, exchange or otherwise distribute your customers’ personally identifiable information without your consent, except to the extent required, in accordance with your instructions, or as identified in this Privacy Policy.

Cloud PaymentsCloudPayments may use your customers’ information, including personally identifiable information, for business purposes including, without limitation, the following:

  • To improve the quality of your Platform access and usage.
  • To provide you access to records associated with your customers’ activity, summaries and analysis about those customers.
  • To run periodic analytics and data mining algorithms that segment your customers to provide you with insights into your customers’ behaviors and potential future activity.
  • To send communications in the form of emails, text messages, and other means of communications provided by the Platform, with information that you have configured and instructed the Platform to send on your behalf.
  • Upon establishing a mutually agreed upon addendum to your SLA, to engage external services to augment and enrich your customers’ data.

Also, Cloud Payments may use your customer’s information, including personally identifiable information, as follows:

  • Cloud PaymentsCloudPayments may contract with other companies and individuals to perform functions or services on its behalf, such as hosting and maintaining the Platform and its various components and access points, payment processing, and database storage and management. These service providers may have access to your customers’ personally identifiable information, such as your email address, needed to perform their functions, but are restricted from using it for purposes other than providing services for Cloud Payments.

Security

The information you voluntarily provide Cloud Payments through use of this Site or the Platform will be stored on Cloud Payments servers located within Cloud Payments’s offices or on service providers such as Amazon AWS. Cloud Payments and any selected service providers follow generally accepted industry standards to protect your and your customers’ personally identifiable information, both during transmission and once Cloud Payments receives it, including the use of firewalls and other Internet security measures, such allowing connections only through SSL encrypted connections. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and Cloud Payments cannot guarantee its absolute security. Accordingly, Cloud Payments expressly disclaims any such obligation.

Third Party Websites

Users may find other content on the Site or Platform that link to the sites and services of Cloud Payments’s partners, suppliers and other third parties. Cloud Payments does not control the content behind the links to these sites or services and is not responsible for the practices employed by websites or services linked to or from the Site or Platform. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to the Site or Platform, is subject to that website or service’s own terms and policies.

Notice to EU Residents

If Cloud Payments receives information from or about a resident of the European Union (“EU”), Cloud Payments will comply with the requirements of the General Data Protection Regulation (“GDPR”). The GDPR provides EU residents with certain rights related to the personal information you have provided to Cloud Payments or Cloud Payments has collected through your use of the Site or Platform. Specifically, EU residents should be aware of the following, and you are responsible for disclosing this to your customers residing in the EU:

  • Cloud Payments will not use an EU resident’s’ data in connection with any automated decision-making process or for any profiling purpose, unless by a lawful request from a governmental agency who has acquired from a court of law a subpoena affirming this usage is necessary for the protection of the public good
  • EU residents have the right to request a copy of the personal information Cloud Payments holds about them.
  • EU residents have the right to request that you and/or Cloud Payments correct or update their personal information if it is incorrect.
  • EU residents have the right to request that you or Cloud Payments delete their personal information from Cloud Payments Platform and servers.
  • EU residents have the right to opt out of certain uses of their personal information, including use of that information for direct marketing purposes.

Residents of the EU should make any of the requests described above to compliance@Cloud Payments.com or to you, and if you cannot address and remedy the request yourself, to forward it to the aforementioned email.

Changes to This Privacy Policy

Cloud Payments may update this Privacy Policy at any time in its sole discretion. When Cloud Payments does update this Privacy Policy, Cloud Payments will revise the updated date in the first paragraph of this Privacy Policy and all changes will be effective immediately. Cloud Payments encourages Users to frequently check this Privacy Policy for any changes and you acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your Acceptance of These Terms

By accessing and using the Site and/or Platform, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, please do not access nor use the Site or the Platform.
